Accepting these terms

This website, margalitmethod.com, is run by Margalit Grunberger, trading as The Margalit Method, from Los Angeles, California. Using the site means you accept these terms. If you do not accept them, the right move is to close the tab.

These terms cover the website: the pages, the articles, the forms, the downloadable guides and the newsletter. They do not replace a coaching agreement or a membership agreement, which are separate documents and are dealt with further down.

Who may use this site

You may use this site if you are 18 or over and legally able to enter a contract. It is built for people who run or lead businesses. Do not use it to break a law, to send anything abusive or false, to scrape it in bulk, to probe it for weaknesses, or to interfere with anyone else's use of it.

The content on this site belongs to Margalit

Everything here is her work: the words, the articles, the frameworks and question sets, the photographs, the design, the logo, the name The Margalit Method, and the guides you can download. It is protected by copyright and trademark law and, where a third party licensed something to her, by their rights.

What you may do

• Read it, print a page for your own use, and share a link to it.
• Quote a short passage, so long as you credit Margalit Grunberger and link back to the page it came from.
• Forward an article to a colleague who would find it useful.

What you may not do

• Republish a whole article or page on your own site, newsletter or platform.
• Sell, license or charge for anything from this site.
• Present her material as your own, or teach it as your own program.
• Feed the content into a system that reproduces or resells it, including training a model on it, without written permission.
• Strip out her name, a credit line or a copyright notice.

The downloadable guides

The Question Vault and the peer group self audit are given to you in exchange for an email address. You get a personal, non-exclusive, non-transferable license to use them for yourself and inside your own company.

You may print The Question Vault, cut it into cards, keep it on your desk, and pull a question out of it in your own team meeting. You may not resell it, hand it out as part of a paid program of your own, post the PDF for public download, or remove the branding. If a colleague wants a copy, send them to the page and let them download their own. That is what it is there for.

What you send through the forms

When you fill in the contact form, the speaking inquiry, a preview session registration or a download form, you are sending information about yourself and sometimes about your business. Three things follow from that.

• You confirm that what you send is accurate, that it is yours to send, and that it does not breach anyone's rights or any confidentiality obligation you are under.
• You give Margalit permission to read it, store it and use it to reply to you and to deliver what you asked for. What happens to it after that is set out in the Privacy Policy.
• A web form is not a secure channel. Do not send trade secrets, personal health details, financial account numbers, or anything covered by a confidentiality agreement. Call instead, or ask for a secure way to send it.

Anything you send that is not personal information, an idea, a suggestion, a comment on an article, may be used without payment or credit. This site does not accept unsolicited business proposals or manuscripts.

Coaching is not therapy, medical care, legal advice or financial advice

This matters more than anything else on the page, so it is stated flatly.

Margalit is a certified professional coach. Coaching is a working partnership that helps you think more clearly and decide better. It is not any of the following, and nothing on this website should be read as any of the following.

• Not psychotherapy, counselling or mental health treatment. Margalit is not a licensed mental health professional and does not diagnose or treat any condition. If therapy is the right support, she will say so and refer you on.
• Not medical care. Nothing here diagnoses or treats an illness. Speak to a physician about anything medical, and never delay care because of something you read on this site.
• Not legal advice. No page here, including the legal pages, creates a lawyer and client relationship or tells you what the law requires of your business. Ask an attorney.
• Not financial, investment, tax or accounting advice. Discussing revenue, pricing or an exit in a coaching session is not a recommendation to buy, sell or structure anything. Take that to your accountant or adviser.

No guarantee of results

Client stories on this site describe what those clients experienced. They are not a promise that the same thing happens to you. Your results depend on your business, your market, your team, your timing and the work you do between sessions, and none of that is inside Margalit's control.

Nothing on this site is a guarantee of revenue, profit, a valuation, a sale, a promotion, a hire, or any other business or financial outcome. No figure quoted anywhere here is a typical result, a projection, or an offer.

Your coaching or membership agreement controls

The website describes how the work is shaped. It is not the contract for it.

One-to-one coaching, a Leader's Hub membership or a workshop engagement is each governed by its own separate written agreement, covering scope, fees, scheduling, cancellation, confidentiality and how either side ends the work. If anything in that signed agreement conflicts with these terms, the signed agreement wins for that engagement.

Payment is handled away from this website. No coaching fee and no Leader's Hub deposit is taken on these pages. Deposit and refund terms, including the $75 refundable preview session deposit, are set out at the point of payment and in your agreement, not here.

Third party links and embedded tools

This site links to podcast episodes, professional networks, the organizations Margalit facilitates for, and an embedded scheduling tool. Those services are run by other people. Their content, their availability and their handling of your information are their responsibility, not hers, and a link is not an endorsement of everything on the far end of it.

The site is provided as it is

The site is offered as it stands and as it is available. Reasonable care goes into keeping it accurate and online, but no promise is made that it will always be available, that every page is free of error, that a link will still work, or that the site or its files are free of anything harmful. Content can change or come down without notice.

Limitation of liability

To the fullest extent the law allows, Margalit Grunberger and The Margalit Method are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profit, lost revenue, lost data, lost opportunity or business interruption, arising from your use of this website or from anything you read on it.

Where liability cannot be excluded, the total amount owed to you for any claim connected with this website is limited to one hundred United States dollars, or the amount you paid Margalit through this website in the twelve months before the claim, whichever is greater. Nothing in these terms limits liability for fraud, for personal injury caused by negligence, or for anything else the law says cannot be limited. Liability under a signed coaching or membership agreement is governed by that agreement.

Indemnity

If your use of this site breaks these terms, breaks the law, or infringes somebody else's rights, and that leads to a claim against Margalit, you agree to cover the reasonable costs, losses and legal fees that come out of it. She will tell you promptly about any such claim and will not settle it without talking to you first.

Governing law and where disputes are heard

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute connected with this website is to be brought in the state or federal courts located in Los Angeles County, California, and both sides accept the authority of those courts.

If a court finds one part of these terms unenforceable, the rest stays in force. A delay in enforcing a term does not waive it.

Changes to these terms

These terms can be updated. The date at the top shows when they last changed, and the version on this page is the one that applies. If a change is substantial, it will be flagged on the site. Carrying on using the site after a change means you accept the new version.
